Hi, need help.
My husband is a sole owner of a local sme.
He boughtt a commercial unit under the company.
If he wind-up his business, how may the ownership of commercail unit tranfer back to himself please?

    Yes. Is it possible to transfer the commercial unit to his personal name? He bot the unit under company's name but he is the sole director of the company.
Dear Mrs Ng, when you wind up a company, you will have to dispose of all the assets, pay of all debts before you can close the accounts and strike off the company. Therefore to "transfer" the property, there is no such direct transfer if I understand what you are asking about. There will be a formal transfer of ownership, from the Company to your husband. Its a conveyancing process which needs to be done legally via lawyers. Stamp duty will be incurred. There are many other considerations involved. Is the commercial unit fully paid for? If not is your husband qualified to hold a mortgage loan? All these considerations need to be thought through as well.
