MinLaw further extends relief period for event, tourism-related contracts

The one-month extension will allow “both individuals and businesses to re-assess the COVID-19 situation and re-evaluate their events or tours in light of Phase 3”.

The relief period for event and tourism-related contacts has been further extended to 31 January 2021 from 31 December 2020, revealed the Ministry of Law (MinLaw) in a release on 31 December.

It explained that the one-month extension will allow “both individuals and businesses to re-assess the COVID-19 situation and re-evaluate their events or tours in light of Phase 3”.

“With Phase 3, there will be more scope to make alternative arrangements and adjustments to the original contract terms,” said MinLaw. 

Parties to a contract for a big wedding, for instance, can agree “to hold the event on the contracted date but at a smaller scale at an appropriately reduced price”. 

“This would be a fair result,” added MinLaw. 

The ministry strongly encourages parties to negotiate the matter in case the contracted event cannot push through due to the pandemic.

They should only apply for relief under the COVID-19 (Temporary Measures) Act if they are unable to reach an agreement, it said.

Notifications for relief for such contracts should be served by 31 January 2021.

In the event an agreement cannot be reached, either party could submit an application for an Assessor’s Determination up to two months following the end of the relief period, by 31 March 2021. 

“In appropriate cases, Assessors may require parties to attend mediation or explain why an alternative arrangement (eg. a smaller scale event or a rescheduled event) is not being considered,” said MinLaw.

The relief periods for the other scheduled contracts remain unchanged.
